The European Accessibility Act (EAA) aims to ensure everyone can use digital products and services - particularly people with disabilities. Stricter cookie compliance means users must be able to clearly understand and control how their data is used. The ICO is already increasing its enforcement activity in the UK, with similar crackdowns happening across the EU and Americas.

Does the European Accessibility Act (EAA) apply to my business if I’m based in Jersey?
The EAA is an EU directive, but it applies to Jersey-based businesses if they:
- Sell digital products or services to consumers in the EU (including through a website or app), or
- Have offices or operations within an EU country.
If either applies to you, your website or digital service will need to comply with EAA requirements from 28 June 2025.
If you’re entirely Jersey-facing, it’s not a legal requirement - but it’s still best practice and may soon be mirrored by local regulation.
I’m based in the UK. Do I still need to comply with the EAA?
If you sell to or operate within the EU, yes. Even though the UK is no longer part of the EU, the EAA applies to any organisation that offers digital services to EU-based users. If you’re entirely UK-facing, it’s not a legal requirement - but it’s still best practice and may soon be mirrored by UK regulation.
What happens if I don’t comply with the EAA?
Non-compliance can lead to:

Jersey’s current Data Protection Law is based on principles similar to the GDPR, and cookie compliance is governed by guidance from the Jersey Office of the Information Commissioner (JOIC). If your website uses non-essential cookies (like analytics, advertising, or tracking), you need:

Where are users’ accessibility preferences stored - and is it compliant?
When someone adjusts settings via the widget (like increasing font size or switching to high contrast), their preferences are stored in a cookie on their device. This ensures their experience is consistent on return visits.
UserWay handles this entirely through their platform - you don’t need to store or manage anything on your side. The process complies with global data protection laws, including GDPR and the EAA, and is managed via the UserWay portal. We’ll configure it in line with your cookie policy and privacy requirements.
